These Terms of Service (“Terms”) govern your access to and use of the NailStream mobile app and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Who We Are
NailStream — Nail art videos, built for a focused community. NailStream is a dedicated space to explore, share, and follow nail art through short video content. Upload your work, discover fresh techniques and styles, and stay connected to creators you care about—right from a streamlined experience.
2) Eligibility (17+)
You must be at least 17 years old to use the Service. By using the Service, you represent that you meet this requirement.
3) Account Registration and Security
- You may need an account to use some features.
- You agree to provide accurate information (such as name/username/email) and keep it up to date.
- You are responsible for safeguarding your account and for activities that occur under your account.
- Notify us promptly if you suspect unauthorized access.
4) Your Content and License
4.1 Your content
You may submit or upload content such as videos, photos, captions, comments, and messages (“User Content”). You retain ownership of your User Content.
4.2 License you grant to NailStream
To operate the Service, you grant NailStream a worldwide, non-exclusive, royalty-free, sublicensable (to our service providers), and transferable license to host, store, reproduce, distribute, publicly perform, publicly display, and create technical modifications of your User Content, solely for:
- operating, improving, and providing the Service; and
- displaying your User Content to others according to your settings (for example, public posts).
This license ends when your User Content is deleted from the Service, except to the extent we need to retain copies for legal, safety, dispute resolution, or backup purposes, or where your User Content has been shared with others and they have not deleted it.
4.3 Permissions you grant
You represent and warrant that you have all rights necessary to grant the license above and that your User Content does not violate any laws or third-party rights.
5) Community Rules and Prohibited Conduct
You agree not to:
- violate any laws or regulations.
- infringe intellectual property, privacy, or other rights.
- post or share unlawful, hateful, harassing, or sexually explicit content, or content that exploits or endangers minors.
- upload malware, attempt to disrupt the Service, or bypass security measures.
- scrape, reverse engineer, or abuse the Service (except where prohibited by law).
- spam, mislead users, or manipulate engagement.
We may remove content, restrict features, suspend, or terminate accounts that violate these Terms or harm the community or the Service.
6) Optional Automated / AI-Assisted Features
The Service may provide optional automated features that generate or enhance content based on your inputs (for example, transforming an image or producing a result from text). You control whether to use these features and whether to upload content for such processing.
7) Privacy
Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and share information.
8) Third-Party Services and App Store
The Service may include features that rely on third-party services (for example, platform services, hosting, analytics, or crash reporting). We are not responsible for third-party services outside our control.
If you downloaded the app from Apple’s App Store, you acknowledge that:
- Apple is not a party to these Terms and is not responsible for the Service.
- Apple has no obligation to provide maintenance or support services for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation.
9) Copyright and IP Complaints
If you believe content on the Service infringes your rights, contact us at kamilbellogma782@outlook.com with sufficient details to locate the content and verify your claim.
10) Termination
10.1 By you
You may stop using the Service at any time. You may request account deletion by contacting us.
10.2 By us
We may suspend or terminate your access to the Service if we reasonably believe you violated these Terms, we must comply with law, or it is necessary to protect the Service, users, or the public.
11) Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, NailStream disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12) Limitation of Liability
To the maximum extent permitted by law:
- NailStream will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill.
- NailStream’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to use the Service in the 12 months before the event giving rise to the claim (or USD $50 if you paid nothing).
Some jurisdictions do not allow certain limitations, so these limitations may not apply to you.
13) Governing Law and Dispute Resolution (Binding Arbitration)
13.1 Governing law
These Terms are governed by the laws of the jurisdiction where NailStream Team is primarily established, excluding conflict-of-law rules.
13.2 Informal resolution
Before starting arbitration, you agree to contact us at kamilbellogma782@outlook.com and provide a brief description of the dispute and your contact information. We will try to resolve disputes informally within a reasonable time.
13.3 Binding arbitration
If a dispute cannot be resolved informally, it will be resolved by binding arbitration on an individual basis, and not in a class, consolidated, or representative action, except where prohibited by law.
The arbitration will be conducted in English by a neutral arbitrator. The arbitrator may award any relief that a court could award on an individual basis.
13.4 Exceptions
Either party may seek injunctive or equitable relief in court for unauthorized use or infringement of intellectual property, or where arbitration is not permitted by applicable law.
14) Changes to These Terms
We may update these Terms from time to time. We will update the “Effective Date” above and, if changes are material, provide notice within the Service or by other reasonable means. Continued use of the Service after changes become effective means you accept the updated Terms.
